The lawsuit, filed on January 7, 2025 alleging that the mandatory membership requirements in local, state, and national realtor associations constitute unlawful “tying arrangement” can be found in our January 14, 2025 update.

The appeal is one of the several similar challenges to NAR’s membership policies.  Parallel cases dismissed at the district court level presently under appeal include (1) Maurice Muhammad v. NAR (Pennsylvania, Third Circuit), and (2) Homie Technology v. NAR (Utah, Tenth Circuit).  Both Plaintiffs are real estate brokers.
